Excluding Yourself From The Class

If you would like to pursue your own lawsuit or claim against Defendants for the claims in this case, do not want to be bound by what the Court does in this case, or if you simply do not want to be part of the Class pursuing claims against Defendants, you need to ask to be excluded from the Class. If you exclude yourself from the Class – which also means to remove yourself from the Class, and is sometimes called “opting‐out” of the Class – you will not be legally bound by the Court’s judgments in this Class Action, and will keep any right you may have to later sue Defendants for the claims being made in the case. If you exclude yourself, you also will not get any benefits from this lawsuit if there are any.

To request exclusion you must send an “Exclusion Request” in the form of a letter sent by mail to Ocean Spray Cranberries Artificial Flavoring Litigation, c/o Law Offices of Ronald A. Marron, 651 Arroyo Drive, San Diego, CA 92103. Your “Exclusion Request” should include your name and address. To be valid, your letter asking to be excluded from the Class must be signed and postmarked no later than April 8, 2019. Or you can fill out the form below.

By submitting this form, you certify that you wish to be excluded from the Class. You will not get any potential benefits if there is a monetary judgment or settlement in favor of the Class, you cannot object to any potential settlement, and you will be responsible for any attorneys' fees and costs you incur if you choose to pursue your own lawsuit. You will not be legally bound by anything that happens in this lawsuit. You may be able to sue (or continue to sue) the Defendants in the future.
